Terms of service

• You must be a business, and the person accepting these terms must be authorized to bind it.
• You are responsible for keeping your account secure and for everything done under it, including by the team members you invite.
• Accounts must be registered by people, not by automated means.

You are responsible for your listings, prices, policies and advertising, and for how you use the leads Raikan delivers. In particular, you agree:

• to comply with fair housing law, including the federal Fair Housing Act and state and local equivalents, and not to use Raikan to discriminate on the basis of any protected characteristic;
• that information you or your connected systems provide (availability, prices, fees, policies) is accurate, because Raikan's pages and answers are built from it;
• to have the rights and consents needed for the content and data you give us, including photos, documents and contact lists;
• to obtain any consent the law requires before you or Raikan contact a prospect, including consent for calls and text messages;
• to follow the terms and advertising policies of Google, Meta and any other platform you connect, including Meta's Housing special ad category;
• not to use Raikan for anything illegal, deceptive or harmful, to send spam, or to probe, overload or reverse engineer the Services.

Raikan uses AI to write pages and ads and to answer prospects, grounded in the information you provide. AI can make mistakes. You can review and edit what Raikan publishes for you, and you remain responsible for the content published under your name. Raikan's answers are not legal, financial or lease commitments; your lease and your staff are the authority on terms.

When you connect a property management system, an advertising account or another service, you authorize Raikan to access it on your behalf as described in our privacy policy. Those services are run by third parties under their own terms, and Raikan is not responsible for them. You keep ownership of your advertising accounts, and ad spend is billed to you by the platform, not by Raikan, unless your order form says otherwise.

• Fees are as shown on your plan or order form, and are paid in advance for each billing period.
• Fees exclude taxes, which you are responsible for unless we are required to collect them.
• If payment fails, we may suspend the Services after notice until it is made.
• We may change prices with at least 30 days' notice by email; changes apply from your next billing period.
• Fees are non-refundable, except as your order form says or the law requires.

• You own the content and data you put into Raikan, the leads it delivers to you, and the pages and ads it generates for you.
• You give Raikan a limited license to use that content and data to provide and improve the Services for you, as described in our privacy policy.
• Raikan owns the Services, including its software, design and templates. You get no ownership rights in them by using them.
• You may export your leads and data while your account is active.

• You may cancel at any time; cancellation takes effect at the end of the current billing period.
• We may suspend or terminate your account if you breach these terms, if required by law, or if your use puts the Services or others at risk. Where we can, we will warn you first.
• When your account ends, your published websites stop serving and your content is deleted as described in our privacy policy.

We improve Raikan continually and may add, change or remove features. If we remove something material to a paid plan, we will tell you in advance.

The Services are provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free, or any particular number of leads, tours or leases.

To the extent the law allows, Raikan is not liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, revenue, goodwill or data, arising from or relating to the Services or these terms, under any theory of liability, even if advised of the possibility. Raikan's total liability for any claim relating to the Services or these terms is limited to the fees you paid Raikan in the 12 months before the claim arose.

You will defend and indemnify Raikan against third-party claims arising from your content, your listings and advertising, your use of leads, or your breach of these terms or of the law, including fair housing and telemarketing law.

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and disputes will be heard in its state or federal courts.

We may update these terms. When we make a significant change, we will update the date at the top of this page and notify account holders by email; continuing to use the Services after the change takes effect means you accept it.
